1. Acceptance of Terms
Welcome to the online store of Desert Island Records. By using our website and making a purchase, you agree to comply with the following terms and conditions. If you do not agree with any part of these terms, please refrain from using our website or making any purchases.
2. Definitions
• “Desert Island Records” or “Seller” refers to DESERT ISLAND LTD, a company registered in Cyprus at Dimitraki Christodoulou 3, Pallouriwtissa, Nicosia 1035 with registration number ΗΕ399349.
• “Website” refers to the Desert Island Records Online Store website.
• “Customer” or “You” refers to any person or entity making a purchase on our website.
• “Products” refers to the physical and digital goods available for purchase on our website.
3. Orders and Payment
3.1 Order Placement: By placing an order on our website, you are making an offer to purchase the selected products. All orders are subject to acceptance by Desert Island Records.
3.2 Prices: The prices listed on our products are in euros and include VAT. They are considered final if they are delivered within Cyprus, except for shipping costs. Shipping costs are paid by the customer and are displayed and invoiced during the order. The Seller reserves the right to modify the prices of the products at any time. However, it is bound by the prices listed in the online store at the time of your order.
3.3 Payment: We accept payment through secure payment gateways. Payment information is protected, and you agree to pay all charges associated with your order. Prices are in the currency specified on the website.
3.4. Product Availability: The customer is informed about the availability of the products through indications that are placed on the page of each product in the online store. The seller reserves the right to make its products available if they are not available at the time of the order and are not responsible in case of stock depletion. In this case, the company reserves the right not to accept the specific order and therefore not to make the sale. Any payments will be returned to the customer without undue delay.
4. Shipping and Delivery
4.1 Shipping Fees: Shipping fees are specified during the checkout process. These fees may vary based on your location and the selected shipping method.
4.2 Delivery: We aim to deliver products within the estimated delivery times, but delays may occur due to various factors. Desert Island Records is not responsible for delays beyond our control.
4.3 Title and Risk: Title to the products passes to you upon delivery. Risk of loss or damage to the products passes to you upon delivery as well.
5. Returns and Refunds
5.1 Returns: A purchased product can be returned to the store of the Seller within 14 working days from the day of the withdrawal request, along with the receipt. It is noted that the responsibility and any costs incurred for transporting the product back to the store are borne by the customer.
The product will be checked by the Seller in a reasonable time to confirm if the product includes the original packaging and the product has not been damaged or has suffered deformations. The customer has the right to open the package carefully and manage the product to the extent necessary to determine the nature of the features and function of the product, as it would be possible to do in a physical store. However, if during the inspection, it is found that any of the above criteria are not met, and that the product has been used by the customer to a point beyond what is necessary to determine the nature, characteristics and function of the product, then the customer is responsible for any reduction in the value of the product. In addition, in cases where the customer is responsible for the destruction of the product or its packaging, or accessories, then the Seller may not return money to the consumer, nor accept the return or change of the product.
The aforementioned shall also apply in cases of returns due to a defective product.
5.2 Refunds: We will issue refunds for eligible returns as per our Return Policy. Refunds will be processed using the same payment method used for the original purchase.
6. Privacy and Data
6.1 Privacy Policy: Your use of our website is subject to our Privacy Policy, which complies with EU data protection laws and governs the collection and use of personal information.
6.2 Security: While we take reasonable steps to protect your data, you acknowledge that online transactions may not be entirely secure. Desert Island Records is committed to safeguarding your data.

8. Limitation of Liability
To the fullest extent permitted by EU law, Desert Island Records shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products.
9. Governing Law and Jurisdiction
The laws of the Republic of Cyprus shall apply with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
Should the purchaser also be the consumer, this only applies to the extent that they do not lose the protection of binding legal provisions of their state of usual residence.
The place of fulfilment for all services and products arising from business transactions with Desert Island Records shall be the Republic of Cyprus Cyprus, insofar as the customer is a merchant, a legal person governed by public law or a special fund under public law.
If the customer is a merchant, legal person governed by public law or special fund under public law, the Republic of Cyprus shall be the exclusive place of jurisdiction for any disputes arising directly or indirectly from the contractual relationship with the customer or from these Terms and Conditions.
10. Alternative dispute resolution
In the event of any controversy or dispute between the Seller and the customer arising out of or in connection with the services provided by the Seller, the parties shall attempt, promptly and in good faith, to resolve any such dispute.
If we are unable to resolve any such dispute within a reasonable time (not to exceed 30 days), then either party may submit a request for a dispute resolution in the European Online Dispute Resolution (ODR) platform provided by the European Commission (https://ec.europa.eu/consumers/odr/main/?event=main.complaints.screeningphase).
If the dispute cannot be resolved through the aforementioned dispute resolution tool, the parties remain free to pursue any right or remedy available to them under the laws of the Republic of Cyprus and resolve any dispute in the Courts of the Republic of Cyprus as stated in clause 9 above.
